LITIGATION
We have extensive civil advocacy experience
not only in the judicial system, but also in administrative
tribunals, in arbitration and mediation proceedings,
and in pretrial and prelitigation negotiation. Our civil
practice includes representation of both plaintiffs
and defendants in:
EMPLOYMENT
AND CIVIL RIGHTS MATTERS
We
have handled many cases involving discrimination based
on race, gender, sexual orientation, age, and disability.
We also have represented both employees and employers
in sexual harassment cases and parties in cases involving
rights of free speech and association.
In
2001, in a retaliation suit brought against the MBTA,
we won a $7.6 million jury verdict-the third largest
jury verdict in Massachusetts that year and the state's
largest employment discrimination verdict up to that
time.
In
October 2005, we won a $2.2 million jury verdict in
a discrimination and retaliation case in federal court.
This verdict was affirmed by the First Circuit in September
2007.
In
a lawsuit brought under the Americans with Disabilities
Act, we recently won an important ruling that persons
with mental disabilities may sue for long-term disability
benefits equal to those available to persons with physical
disabilities.
We
handle many cases for university faculty and staff,
including tenure, promotion and discipline.
FAMILY LAW
We
represent parties in complicated divorce and post-divorce
cases involving division of substantial assets, alimony,
child support, and custody of minor children.
We
have special expertise in handling child custody and
asset division issues for same-sex and unmarried couples.
We
recently won, after trial, a favorable asset division
for a husband whose spouse alleged he gambled away significant
assets.
We
also won, after trial, a substantial division of assets
for a wife who had signed a very restrictive prenuptial
agreement.
PERSONAL
INJURY
Our
experience in this area includes workplace, automobile,
and airplane accidents, and medical malpractice cases.
We have settled numerous serious motor vehicle and pedestrian
accident cases.
We
obtained a substantial settlement shortly before trial
in a medical malpractice case against a surgeon.
We
obtained a large settlement for the family of a college
student killed by a U.S. Post Office truck.
We
recently won a jury trial against a college for classroom
injuries suffered by a student.
CONSTRUCTION ACCIDENTS
We negotiated a substantial settlement on behalf of
a widow whose husband died in a motor vehicle accident
related to the Big Dig.
We
obtained a large settlement for the family of a college
student killed by a U.S. Post Office truck.
BUSINESS
AND OTHER CIVIL DISPUTES
We represent parties in licensing boards and university
discipline cases.
In
a dispute over misappropriation of confidential information,
arbitrated by the National Association of Securities
Dealers, we negotiated a monetary settlement in favor
of our clients, who were the defendants.
